Terms of Service

1. Who we are and what this covers

Transformative Minds is an adaptive learning service for children with special educational needs. These terms apply to every adult who creates an account — parents, carers, teachers, therapists and school administrators — and to any child who learns through an account an adult has set up.

By creating an account or using the service you accept these terms. If you do not accept them, please do not use the service.

2. Accounts and who may use them

Accounts are held by adults aged 18 or over. Children never hold their own account and never sign in independently; they learn inside a session an adult opens for them.

You are responsible for keeping your sign-in details private and for everything done through your account. Tell us straight away if you think someone else has access to it.

You confirm that you have the right to add each child you create a learner record for — as their parent or carer, or under your school's or setting's lawful arrangements.

3. What the service does — and does not do

Transformative Minds works out which maths and literacy skills a child finds difficult and builds practice around them. It describes support needs; it does not diagnose, assess clinically, or replace an education, health and care plan, a specialist assessment, or professional advice.

Progress reports are a guide for grown-ups. They are not a formal attainment record and should not be the only basis for decisions about a child's education or care.

4. School accounts, seats and parent pricing

A school can set up its own account with its name and logo, buy places (seats) for its families, and set the rate it charges those families. One seat covers one parent or carer account.

Where a school sets a rate, that arrangement is between the school and the family. We are not a party to it and we do not collect that money on the school's behalf.

Parents join a school account using the school's invitation link and join code. A school may only issue those to families it is entitled to enrol.

5. Fees and payment

Independent family subscriptions and school seat purchases are charged at the price shown at the time of purchase. Prices may change, and we will tell you before a change affects you.

We may place an account on credit stop, or suspend it, where fees are overdue. Learner data is retained during a credit stop so that access can be restored once the account is settled.

6. Acceptable use

Do not attempt to access another person's account or a child's records without authority, upload unlawful or harmful content, disrupt or reverse engineer the service, or use it to collect data about children for any purpose other than supporting their learning.

We may suspend or close an account that breaches these terms, that puts a child at risk, or that we are required to act on by law.

7. Availability and changes

We work to keep the service available, but we do not guarantee uninterrupted access. Features may change, be added, or be withdrawn as the service develops.

We may update these terms. Where a change is significant we will let account holders know before it takes effect.

8. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited.

Otherwise, and to the extent the law allows, we are not liable for indirect or consequential loss, and our total liability is limited to the fees paid for the service in the twelve months before the claim.

9. Ending your use

You may close your account at any time. A school may release a seat, which ends that family's access under the school account.

When an account is closed we delete or anonymise learner records in line with our Privacy Policy, unless we must keep something to meet a legal obligation.

10. Governing law and contact

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
